No fault divorce


Today, we welcome the arrival of 'no fault' divorce. Before, you had to give a reason for the irretrievable breakdown of a marriage. Now it is enough to say that the marriage has broken down irretrievably and you don't need to apportion blame. Progress, we think. You will not be able to obtain a conditional divorce until 20 weeks have passed from when you make your application. However, you can start discussing how best to separate finances and how arrangements for children of the family will work, going forwards. Arrangements made in mediation can be made into a legally binding part of your divorce and mediators can support the discussions which will get you to the end of the process.
